There are two treatment options for performing voluntary abortion (according to the Protocol for the Prevention of Unsafe Abortion in Colombia of the Ministry of Health, 2014), surgical treatment and medical treatment. Abortion advocates welcome yesterday`s decision by Colombia`s Supreme Court. Yes. Any woman, regardless of age, can turn to the health system and make her right to abortion effective without being disabled, provided that her case corresponds to one of the three legal circumstances. Minors under the age of 14± must be accompanied by ± responsible adult. The Constitutional Court`s judgment C-055 of 21 February 2022 made an amendment in Colombia that allows abortion freely and legally until 24 February 2022. Abortion is a fundamental right protected by Colombian law. In Colombia, abortion was decriminalized from ±, 2022 (sentence C-055) to the 24th week of pregnancy. This means that you can exercise your right to access free, legal and safe abortion services without requiring compliance with any requirements or conditions. It`s up to you! In 2022, Amnesty International (AI) estimates that around 400,000 abortions will be performed in Colombia, of which 90% – around 360,000 are clandestine or unsafe abortions and are performed without adequate hygiene measures – and only 10% will be performed in health facilities.  In Chile, the green tide triggered a reform project to decriminalize abortion up to 14 weeks. The proposal was rejected in Congress in November 2021 because it did not have the support of the Conservative government; However, with the entry of a new left-wing government, it is possible that the measure will be adopted in the coming months. “While the decriminalization of abortion in the first 24 weeks is an important step for abortion rights in Colombia and Latin America and the Caribbean, no one should be criminalized for their access to abortion. It is crucial that we continue to advocate for full access to safe and legal abortion in all circumstances in Colombia and beyond,” added Erika Guevara-Rosas. It has been assumed that conception as a cause of rape is likely to cause serious psychological harm to women, so the Colombian legal system considers this case as one of the alleged cases in which the pregnant woman is legitimized to terminate the pregnancy.
The C355/06 judgment of the Colombian Constitutional Court decriminalized abortion when the pregnancy is the result of behavior that constitutes violent, abusive, properly denounced carnal access or artificial insemination or transmission of fertilized eggs that are not consensual, or incest. For years, many women`s and human rights groups have been calling for an end to the criminalization of abortion in Colombia. In 2020, the Just Cause Movement filed a lawsuit to remove the crime of abortion from the law. Denying the performance of IVE to a woman who is in one of the three approved causes has a negative impact on her mental health and reduces the conditions that guarantee an optimal quality of life. The state of illegality, the resulting secrecy, the loneliness and silence in which abortions are performed in Colombia are the main causes of suffering and/or guilt for some women. In which© cases is IVE or abortion allowed in Colombia? Less than a year later, in September 2021, Mexico`s Supreme Court passed the decriminalization of abortion. This decision only affected the legislation of the state of coahuila and does not imply that abortion is legal throughout Mexico, but it does set a legal precedent that could change laws in the rest of the country. It is important to clarify that not all malformations in the fetus are a legal cause of abortion, but only those that prevent life outside the uterus. With the new law, the crime of abortion still exists, but only if the pregnancy is terminated after 24 weeks (with the exception of the three cases mentioned above). In French Guiana, the same legislation applies as in France, where abortion is legal in all cases up to 12 weeks. The French government legalized abortion in 1975 and introduced it into the social security system in 1982.
Since 1977, it has been providing medical and counselling services for sexual and reproductive health, with a focus on the prevention and comprehensive care of legal abortion in Colombia.
